After historic rulemaking in 2020 that required detailed procedures for incidents of alleged sexual harassment, the Department plans to release a Notice of Proposed Rulemaking this month that will change its enforcement approach on several fronts. Aimed at “fair, prompt, and equitable resolution of reports of sexual harassment and other sex discrimination” and “addressing discrimination based on sex, including sexual orientation and gender identity, in educational environments,” the new proposed rule is likely to signal a shift in focus and to require new procedures.
